Welcome to TrippyCart.

These Terms of Service govern your access to and use of the TrippyCart website and your purchase of products through the platform.

By accessing the website, placing an order or otherwise using TrippyCart, you agree to these Terms.

If you do not agree with these Terms, please do not use the website.

1. About TrippyCart

TrippyCart is operated by Ajmera Associates, a proprietorship registered in Rajasthan.

TrippyCart operates as an online marketplace featuring products from third-party brands and sellers.

2. Eligibility

You must be 18 years of age or older to access and purchase products from TrippyCart.

By using the website, you confirm that:

  • You are at least 18 years old;
  • The information provided by you is accurate;
  • You have the legal capacity to enter into a transaction; and
  • Your use of the website and products will comply with applicable law.

TrippyCart may refuse or cancel an order where it reasonably believes that the customer does not meet the applicable age or legal requirements.

3. Age Verification

TrippyCart uses an age-verification gate before users enter the website.

The age gate currently operates through a front-end confirmation and does not constitute formal government-ID verification.

Users must not falsely confirm their age.

4. Products

TrippyCart offers products including, among others:

  • Rolling papers;
  • Filters;
  • Grinders;
  • Ashtrays;
  • Trays;
  • Storage jars;
  • Cleaning accessories;
  • Lighters and lighter accessories;
  • Butane lighter refill cans;
  • Sheesha/hookah products;
  • Non-tobacco herbal mixers;
  • Condoms;
  • Wet wipes;
  • Protein bars;
  • Incense and scented candles; and
  • Other lifestyle, accessory and collectible products.

TrippyCart does not sell tobacco, nicotine products, vape/e-cigarette products, cannabis, CBD or similar prohibited/regulated products through the store.

5. Lawful Use

Products purchased through TrippyCart must be used only for lawful purposes.

TrippyCart does not encourage, endorse or facilitate illegal drug use or any other unlawful activity.

Customers are solely responsible for ensuring that their purchase, possession and use of a product complies with the laws applicable to them.

6. Marketplace & Sellers

TrippyCart features products supplied by third-party brands and sellers.

Relevant seller information is made available on the website where applicable.

TrippyCart manages the customer-facing shopping and fulfilment experience, including pricing, inventory/fulfilment and shipping arrangements.

Seller/product information must be accurate and correspond to the relevant products. Indian e-commerce rules require marketplace entities to display relevant seller information and information necessary for informed purchasing decisions.

7. Pricing

TrippyCart determines the selling prices displayed on the platform.

Products will not intentionally be sold above their applicable MRP where MRP is required to be displayed and applicable.

Prices may change from time to time.

In the event of a material pricing error, TrippyCart reserves the right to cancel the affected order and provide an appropriate refund.

8. Orders

Placing an order constitutes an offer to purchase the selected products.

An order confirmation does not necessarily constitute final acceptance if the order subsequently becomes subject to:

  • Stock unavailability;
  • Pricing errors;
  • Fraud concerns;
  • Payment issues;
  • Logistics restrictions;
  • Product restrictions;
  • Age/eligibility concerns;
  • Incorrect information; or
  • Other legitimate operational or legal reasons.

TrippyCart reserves the right to cancel or refuse an order in such circumstances.

9. Guest Checkout

TrippyCart allows customers to place orders using guest checkout.

Customers remain responsible for providing accurate contact and delivery information.

10. Resale

Customers may purchase products for legitimate resale purposes, subject to applicable law, product restrictions and any applicable manufacturer/brand restrictions.

TrippyCart does not guarantee that any product is suitable for commercial resale or that the customer has obtained any licence or permission required for resale.

11. Payments

TrippyCart may offer:

  • UPI;
  • Credit/debit cards;
  • Net banking;
  • Wallets; and
  • Cash on Delivery.

Payment availability may vary by order, location, product or payment provider.

Applicable fees, including COD charges, will be displayed at checkout.

12. Shipping

Shipping is governed by our Shipping Policy, which forms part of these Terms.

13. Returns & Refunds

Returns and refunds are governed by our Returns & Refund Policy, which forms part of these Terms.

Given the nature of certain products sold through TrippyCart, many products are non-returnable.

14. Order Cancellation

Customers may cancel an order only before it enters the packing/dispatch process.

Once an order has been packed or dispatched, cancellation will generally not be permitted.

15. Fraud & Abuse

TrippyCart reserves the right to suspend, restrict or cancel orders/accounts where it reasonably suspects:

  • Fraudulent activity;
  • Payment abuse;
  • Repeated COD refusal;
  • False claims;
  • Return/refund abuse;
  • Manipulation of promotions;
  • Misuse of the website;
  • Identity or age misrepresentation;
  • Unlawful activity; or
  • Other activity that creates a material risk to TrippyCart, its sellers, logistics partners or customers.

16. Product Information

We make reasonable efforts to ensure that product descriptions, images, prices and specifications are accurate.

However, minor differences may occur between product images and the actual product due to screen settings, packaging updates, manufacturing changes or brand variations.

Where a product's physical characteristics materially differ from its listing, customers may raise a claim in accordance with our Returns & Refund Policy.

17. User Reviews & Content

Customers may submit reviews, photographs, videos or other content where the relevant functionality is available.

By submitting content, you represent that:

  • You own or have the necessary rights to submit it;
  • It does not infringe another person's rights;
  • It is not fraudulent or misleading;
  • It does not contain unlawful material; and
  • It complies with applicable law.

You grant TrippyCart a non-exclusive, royalty-free right to use, reproduce, display and publish submitted content for operating, promoting and improving the website and its products.

TrippyCart may remove or restrict content at its discretion where it considers the content inappropriate, illegal, misleading, abusive, fraudulent, infringing, spam or otherwise inconsistent with these Terms.

18. Intellectual Property

All TrippyCart branding, logos, website design, original text, graphics, software and other original website materials are owned by or licensed to TrippyCart unless otherwise stated.

TrippyCart's trademark application is currently pending.

Third-party brand names, logos, trademarks, product images and other intellectual property remain the property of their respective owners.

Nothing in these Terms grants you ownership of TrippyCart's intellectual property.

19. Prohibited Website Use

You must not:

  • Use the website for unlawful purposes;
  • Attempt to bypass age restrictions;
  • Attempt unauthorised access to the website;
  • Introduce malicious software;
  • Scrape or misuse website content;
  • Submit fraudulent reviews;
  • Impersonate another person;
  • Use the website to facilitate unlawful activity;
  • Attempt to interfere with website security; or
  • Abuse promotions, refunds or customer-service processes.

20. Third-Party Services

TrippyCart uses third-party service providers, including Shopify, payment processors and logistics partners.

Their services may be subject to their own terms and policies.

21. Limitation of Liability

To the maximum extent permitted by applicable law, TrippyCart will not be responsible for indirect, incidental, special or consequential losses arising from use of the website or inability to use the website.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

22. Force Majeure

TrippyCart will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, severe weather, strikes, transportation disruptions, government restrictions, internet or infrastructure failures, or other similar events.

23. Governing Law

These Terms are governed by the laws of India.

Subject to applicable law, courts located in Jaipur, Rajasthan shall have jurisdiction over disputes arising from these Terms or your use of TrippyCart.

24. Changes to These Terms

We may update these Terms from time to time.

The updated version will be published on the website and will become effective from the date specified in the updated Terms.
